Beware the faux ami in English

Beware of the faux ami: What every other language calls "legal process" (in literal translation), more or less, is "legal proceeding" in English, not "legal process", which in English is something else.

There is a distinction in English between "legal proceeding" (a judicial activity) and "legal process" (documents). Somewhat counterintuitively, "legal process" is not a "process" in the normal English sense, but a set of documents. To "serve process" in English, is to hand documents over to someone, and the documents you hand over, are the "process". A "process server" is a job title, for someone who hands over legal documents. There are only four Wikipedia versions, which have articles for Q6087062 as well as Q1301203: German, Spanish, Esperanto and Simple. Thirteen Wikipedia versions have articles only for Q6087062.

However, due to the German Wikipedia Q6087062 is – nevertheless – the broader concept: ‘Ein Prozess ist ein streitiges Verfahren vor einem Gericht […]. Der Begriff ‚streitiges‘ Verfahren bezieht sich auf die Abgrenzung zu ‚nichtstreitigen‘ Verfahren, die ebenfalls von Gerichten durchgeführt werden; zu den letzteren zählen z. B. Verfahren, die die Eintragung von grundstücksbezogenen Rechten in das Grundbuch betreffen. When we accept this, then it would be appropriate to change the English label for Q1301203 from ‘legal proceeding’ into ‘contentious legal proceeding’.

But I don’t know, whether the narrower concept fits to all 17 Wikipedia articles for Q1301203. As well I don’t, whether the contentious character of a ‘Prozess’ constitutes as well for Spanish, Esperanto and (simple) English the differentia specifica (Q488677) between Q6087062 and Q1301203.

The Spanish notion: Procedimiento (judicial) a synonym of rules of procedure?

Seemingly ‘Procedimiento (judicial)’ refers more to the rules (‘legalmente previsto’) of procedure then to the procedure (itself), which is constituted through the application (or violation) of the rules of procedure.

Maybe it is necessary to distinct between

  • the normative (or formal) notion: ‘Procedimiento (judicial)’ / Verfahren[6] as synonym of the rules of procedure (‘las normas’)

and

  • the institutional (or praxeological) notion: ‘Procedimiento (judicial)’ / Gerichtsverfahren as the practice of application of the rules of procedure (‘la tramitación’ / ‘la realización’):

es:Procedimiento judicial: ‘En su sentido más amplio, se refiere a las normas de desarrollo del proceso, de ritualidad, tramitación, o formalidades para la realización de los derechos subjetivos con el debido respeto a los derechos y garantías.’
